Terms of Service

These Terms govern the consumer OpenFoxy service, including the Windows application, web experience, mobile experience, local-AI node, remote-access features, and related services.

OpenFoxy Free is advertising-supported and is for users age 18 or older. Internet connectivity is required for installation and for normal use of the free service, including account authentication, remote access, updates, model/runtime setup, and advertising delivery.

1. Eligibility and Age

You must be at least 18 years old to create an OpenFoxy account, install or use the consumer service, or accept these Terms. By accepting these Terms, you represent and confirm that you are 18 years of age or older.

You must provide accurate account information and are responsible for maintaining the security of your credentials and devices.

2. OpenFoxy Free and Advertising

OpenFoxy Free is supported in whole or in part by advertising. Advertising is an integral part of the free service and may be displayed throughout normal use of OpenFoxy on Windows, the web, mobile devices, and other supported OpenFoxy interfaces.

By accepting these Terms and using OpenFoxy Free, you authorize OpenFoxy to display advertisements, sponsored recommendations, sponsored listings, promotional content, and similar commercial content on supported OpenFoxy screens. Advertising availability, frequency, placement, format, and relevance may vary.

Sponsored content will be identified as advertising or sponsored content where appropriate. OpenFoxy may use privacy-preserving contextual signals derived from the current interaction to select relevant advertising as described in the Privacy Policy.

You may not intentionally disable, bypass, tamper with, manipulate, falsify, or interfere with OpenFoxy advertising delivery, viewability measurement, integrity checks, or related controls. OpenFoxy may restrict or suspend the free service where material tampering or circumvention is detected.

3. Local AI and Remote Access

OpenFoxy may run AI inference on your own compatible computer using downloaded runtime components and AI models. Your computer may act as your personal OpenFoxy AI node and may remain available to your authenticated OpenFoxy account from other supported devices while the computer is online.

Remote use requires your OpenFoxy computer to be powered on, connected to the internet, signed in or enrolled as required, and able to run the applicable OpenFoxy components. OpenFoxy does not guarantee continuous remote availability.

Requests and responses used through web or mobile remote access may transit OpenFoxy systems as necessary to authenticate, route, relay, protect, and provide the service. Conversation history may be stored with your account where the product provides history or synchronization.

4. Internet, Downloads, and Updates

An internet connection is required to complete installation and for normal operation of OpenFoxy Free. OpenFoxy may download application components, AI runtimes, models, security data, configuration, and updates appropriate for your device.

OpenFoxy may automatically install security, integrity, compatibility, application, node, or runtime updates. Large AI-model upgrades may be presented separately or require confirmation depending on product settings and download size.

Downloaded components may consume significant storage space, bandwidth, CPU, GPU, memory, and electricity. You are responsible for your device, connection, and utility costs.

5. Software Integrity and Third-Party Components

OpenFoxy may include or download third-party software, runtimes, models, libraries, and other components governed by their own licenses. OpenFoxy may verify component signatures, hashes, manifests, and integrity state.

You may not modify, replace, forge, disable, or circumvent OpenFoxy security or integrity controls, device authorization, update verification, advertising integrity, or access restrictions, except to the extent a restriction is prohibited by applicable law.

OpenFoxy may refuse to run a modified or untrusted component and may repair or re-download affected components.

6. Acceptable Use

Your use of OpenFoxy is also subject to the OpenFoxy Acceptable Use Policy. You may not use the service to violate law, infringe rights, compromise systems, distribute malware, abuse other users, or evade lawful access and security controls.

7. AI Output

AI-generated output may be inaccurate, incomplete, offensive, outdated, or unsuitable for a particular purpose. You are responsible for evaluating output before relying on it, especially for legal, medical, financial, safety-critical, or other high-impact decisions.

OpenFoxy does not guarantee that a particular model, response, feature, ad, advertiser, or remote-access function will always be available.

8. Account Suspension and Termination

OpenFoxy may suspend, limit, or terminate access for violations of these Terms or the Acceptable Use Policy, fraud, abuse, security threats, attempts to circumvent advertising or integrity controls, legal requirements, or conduct that creates material risk to OpenFoxy, users, advertisers, or third parties.

You may stop using OpenFoxy and uninstall the software. Device authorization may also be revoked through supported account controls.

9. Disclaimers

To the fullest extent permitted by law, OpenFoxy is provided on an “as is” and “as available” basis without warranties of uninterrupted availability, accuracy, merchantability, fitness for a particular purpose, or non-infringement.

Nothing in these Terms excludes rights or warranties that cannot legally be excluded.

10. Limitation of Liability

To the fullest extent permitted by applicable law, CodeGuard Host LLC and its affiliates, personnel, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost opportunities, business interruption, or lost data arising from or related to OpenFoxy.

Where liability cannot legally be excluded, it is limited to the maximum extent permitted by law.

11. Changes to These Terms

CodeGuard Host LLC may update these Terms as OpenFoxy evolves. OpenFoxy maintains versioned legal documents. Material changes may require you to review and affirmatively accept a new version before continuing to use affected services.

For changes that do not require renewed consent, OpenFoxy may provide notice through the service, email, the website, or another reasonable method.

12. Governing Law and Contact

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles, except where mandatory consumer law requires otherwise. Subject to non-waivable rights, venue will lie in courts of competent jurisdiction serving Dallas County, Texas.
